What is Umowa zlecenie in Poland?

Umowa zlecenie is a civil law type of contract regulating the relationship between an employee and his employer. The name can be translated into Russian as an order contract or an assignment contract. Such a contract can be concluded for a certain amount of work and/or time period.

What should be written in the Umowa zlecenie?

Full names of the parties, and in the case of signing between an individual and a legal entity or two legal entities, details of the persons authorized to do so.
For individuals: dates of birth; residential addresses;
Identity cards (their details); social/tax identifiers (PESEL, NIP, etc.).
For legal entities, their registration details, addresses, and details of representatives are provided.

Umowa zlecenie has no statutory restrictions on the duration of its validity.
The 18-month limitation applies only to cases of using a temporary employment agency, when working for the same employer-user. Moreover, the one-and-a-half-year limits apply not only to temporary employment contracts, but also to any other type of contract, which is additional confirmation that the type of contract itself does not matter.

Can a temporary employment contract be of unlimited duration?

If the client (customer, conditionally – employer) assigns work under a temporary employment contract on a permanent basis, he will be able to conclude a contract with the contractor (performer, conditionally – employee) for an indefinite period. Such a situation is legally permissible, but it is necessary to ensure that a contract for an indefinite period cannot be considered an employment contract (umowa o pracy).
