Clock change on 25 October: how the extra hour on a night shift in Poland must be paid

In short: on the night from Saturday 24 to Sunday 25 October 2026 Poland goes back to winter time: at 3:00 the clocks go back to 2:00. A night shift from 22:00 to 6:00 lasts 8 hours on the clock but 9 in reality. According to the National Labour Inspectorate (PIP), if the employer did not plan for it in the schedule, the extra hour is overtime: you are owed normal pay for it, a 100% overtime supplement (or time off) and the night allowance. On an umowa zlecenie (civil-law contract) the law gives no supplements, but the hour must be paid. This is not a new law: these are the Labour Code rules already in force.

What you are owed for the extra hour

Umowa o pracę, including through an agencyUmowa zlecenie
Pay for the hour itselfYes, like any working hourYes, at the contract rate, at least 31.40 zł gross per hour
Overtime supplement100% of the rate, because the hour falls at night and on a Sunday. Time off can replace itNo, unless the contract provides for it
Night allowanceYes, on top: in October 2026, 5.46 zł gross per hourNo, unless the contract provides for it
Hours recordedIn the working-time record (ewidencja czasu pracy): 9 hours, not 8In the contract's hours record: 9 hours

The night allowance is 20% of an hourly rate worked out from the minimum wage: 4,806 zł ÷ 176 working hours in October × 20% = 5.46 zł. It is paid regardless of the overtime supplement.

When there is no extra hour

If the work does not have to run without a break, the employer can plan the shift in advance as 7 hours on the clock instead of 8 (or 11 instead of 12). With the clock change you then work exactly 8 (or 12) hours and there is no overtime. So the first thing to check is your schedule for that night.

An example

PIT.pl worked out an example for a salary of 6,000 zł gross a month: the hourly rate in October is 6,000 ÷ 176 = 34.09 zł. For the extra hour: 34.09 zł pay + 34.09 zł 100% supplement + 5.46 zł night allowance = 73.64 zł gross. With a different salary, use your own rate.

What to do

  1. Check your schedule for the night of 24/25 OctoberAn 8-hour shift on the clock means you will work 9.
  2. Record the hours you actually workedYour timesheet or app should show 9 hours, not 8.
  3. Choose: money or time offTime off at your written request is 1 hour for 1 hour. If the employer gives time off without your request, it is 1.5 hours for each hour. The night allowance stays either way.
  4. Check your October payslipLook for the lines nadgodziny (overtime) and dodatek nocny (night allowance). If they are missing, ask your employer or agency.

If you work through an agency

On an umowa o pracę tymczasową (temporary employment contract) your employer is the agency, and the Labour Code applies to it. So the rules are the same: the extra hour, the supplement and the night allowance. Profi Hand is an employment agency registered in KRAZ under number 32053. All our services are free for you.

When do the clocks change in 2026?

On the night from Saturday 24 to Sunday 25 October: at 3:00 the clocks go back to 2:00, so the hour from 2:00 to 3:00 happens twice.

I work the day shift. Does this concern me?

No. Only people working that night between 2:00 and 3:00 get the extra hour.

Why 100% and not 50%?

Under the Labour Code (art. 151¹) overtime at night, and on a Sunday that is not your working day, carries a 100% supplement. The extra hour falls on the night from Saturday to Sunday.

Am I owed nothing on an umowa zlecenie?

The law gives no overtime or night supplements on a zlecenie unless the contract includes them. But every hour worked must be paid, at least 31.40 zł gross in 2026. So you should be paid for 9 hours for that shift.

What if the extra hour was not paid?

First ask your employer or agency: it is often a mistake in the records. If that does not help, the National Labour Inspectorate (PIP) gives free advice on 801 002 006 or 459 599 000. More on the minimum rate in our article on the minimum wage in Poland.

Do I have to pay an agency to help me find work?

No. All our services are free for you.
